In a groundbreaking legal victory, the Dallas-based law firm Dean Omar Branham Shirley, LLP has made headlines by refusing a settlement offer from Johnson & Johnson following a $45 million talc verdict.
The verdict, awarded in Chicago’s Cook County Circuit Court, marks a significant milestone in the fight against talc-related illnesses. Representing the family of Theresa Garcia, who tragically passed away from mesothelioma in 2020, the firm stood firm in their pursuit of justice, rejecting Johnson & Johnson’s offer despite the potential implications for their other clients.


Jessica Dean , a prominent figure at Dean Omar, made it clear that the firm’s decision to decline the settlement was driven by a commitment to their clients’ interests. Refusing to compromise on accountability, the firm’s stance underscores their dedication to seeking justice for those affected by talc-related illnesses.


The jury’s decision, which attributed 70% of responsibility to Kenvue (formerly part of Johnson & Johnson) and 30% to other entities, reflects the compelling evidence presented by Dean Omar’s legal team. Throughout the trial, experts testified to the presence of #asbestos fibers in Johnson & Johnson’s products, linking them to Garcia’s tragic diagnosis.


Johnson & Johnson, however, remains steadfast in their assertion that talc is safe and does not cause cancer. Erik Haas , J&J’s Worldwide Vice President of Litigation, expressed plans to #appeal the verdict immediately, citing decades of scientific evaluations supporting their position.


Dean Omar’s refusal to settle serves as a beacon of hope for those seeking accountability from corporate giants. With another talc trial on the horizon, scheduled for May 8 in Portland, the firm remains undeterred in their pursuit of justice for victims of talc-related illnesses.
